Facts: MZI is a Pakistani national living in the UK. He was married to an EEA national and the marriage lasted more than 3 years. He had valid residence card for five years ending in the year 2019. The marriage ended due to unreasonable behavior. He wanted to make retention of right of residence on that basis.
Advice: We discussed the requirements and the procedure of making retention of right of residence application with the client. Provided him with a list of documents and information need for the application.Prepared a covering letter addressed to the home office explaining how the applicant fulfils all the requirements for retaining right of residence under the EEA regulations, while referring to the documents provided with the applications.
Outcome: The Home office approved the application within 3 months.
Further advice: Advised that upon completion of 5 years from the date of his marriage, he will become eligible for permanent residence under the EEA regulations.
