If a British citizen gets married to a Non-EEA Resident, a spouse visa is needed for the partner to travel and stay in the UK.
If you find yourself in this situation then a spouse visa could be a viable option of having your partner permanently reunite with you in the UK.
A Spouse Visa UK (also known as Marriage Visa) allows a partner of a UK citizen / a person permanently settled to enter the UK and be able to live, work and study there without restrictions.
Our immigration consultants understand the delicacy and value of such a relationship with your spouse and are ready to assist you.
The UK spouse visa is more of a sequential process towards permanent settlement and eventually British citizenship. Each step down the road takes a different duration of time. It can be broken down into two phases.
1. Applying for a ‘Spouse Visa’ entry clearance, and
2. Applying for an ‘Indefinite Leave to Remain or settlement when you are in the UK on a spouse visa
The length of your spouse visa depends on where you are applying from. If you are applying from within the UK, the duration of your visa will be 30 months.
This means that you are permitted to live, study and work in the UK for 30 months. On the contrary, if you apply from outside the UK, your visa duration is for 33 months.
28 days before your spouse visa in the UK is expiring, you can apply for an extension of leave to remain in the UK. Once you have completed 5 years of legal stay in the UK, then the most suitable option for you is to apply for ‘Indefinite Leave to Remain’ also known as ILR.
This is issued to you by the UK Home Office.
So, the goal here is to spend 5 years on a spouse visa, by getting an extension once or twice and then applying for an Indefinite Leave to Remain.
Some people might call it ‘Permanent Residence’, however as explained above it is called Indefinite Leave to Remain.
