Variation of leave to remain application

Facts:

AB is a national of Pakistan. She made her application for further leave to remain on the basis of a Tier 1 Entrepreneur visa.

The home office took extraordinary time to consider her application and whilst her application was pending, she completed her 10 years of lawful and continuous residence in the UK.

Advice:

Advised her to vary her leave to remain applicable to that of Indefinite leave to remain application as soon as possible.

Advised her to pass the life in the UK test and provide other documents required for her variation of leave to remain application from Tier 1 Entrepreneur to Indefinite leave to remain application.

Completed SET LR application, prepared a covering letter addressed to the home office explaining how she fulfils all the requirements of the ILR application whilst making references to the documents provided with her Tier 1 Entrepreneur application and the ones enclosed with her SET LR application.

Outcome:

The Home office granted indefinite leave to remain to the client in four months’ time and also refunded the difference of fee that she paid.
